Description
Langhorne Borough is establishing a Code Appeals Board, a quasi-judicial body that hears the appeals of the decisions of the Borough’s Building Code Officials. The Board is authorized to uphold, reverse, or modify decisions of Code Officials or grant variances to building code requirements where appropriate provided that the intent of the building code is upheld. The purpose of the Code Appeals Board is to provide residents and those undertaking building construction projects in the Borough an avenue to appeal decisions rendered by the Borough’s Code Officials.
In order to appear before the Code Appeals Board, residents and contractors will be required to submit a formal appeal or variance application. An appeal of the decision of the Borough’s Code Officials must be submitted within thirty days of the decision along with the required application fee as determined by the Borough and listed in the annual fee schedule. Upon receipt of the application, the Code Appeals Board shall schedule a public hearing, where a majority of appointed members will review the matter and render a decision.
The Code Appeals Board will consist of three members qualified to pass judgement on matters of building construction (such as licensed architects and engineers, building inspectors, plan reviewers, etc.) and two alternates to fill vacancies as needed. Like the Borough’s other boards & committees, members will serve on a volunteer basis. Members will be appointed by Borough Council upon receiving and reviewing a letter of interest and resume and will serve three-year terms. The Board will elect a Chairperson and Vice-Chairperson annually from among its members.
