ZONING HEARING BOARD UPDATE

Description
The Borough of Hatboro Zoning Hearing Board met on Wednesday, March 11th to hear the following two matters.
1. Application 2026-02; JSC Rehabs LLC equitable owner of 14 E. Moreland Avenue who has been before the ZHB in January and February and was seeking two variances, first from 27-12021.M of the Borough Code of Ordinances to permit 12 dwelling units to be located on the first floor of the building withing the RC-2 Retail Commercial District. The second variance was from 27-2002.3 of the Borough Code of Ordinances to permit a total of 39 off-street parking spaces on the property opposed to the 53 total spaces required by the code for residential and commercial uses.
The Zoning Hearing Board heard further testimony from the applicant and his attorney that changes were made to the project to now only have a total of 18 units (on first and second floor) and 800 square feet of commercial space. By making these changes the applicant withdrew the second variance for parking, as the parking requirements of 39 spots were now satisfied. The Zoning Hearing Board granted to request for the variance for the dwelling units on the first floor.
2. Application 2026-03 - Alita Investments, LLC, 19 Byberry Road requested the following variances from the Borough Code of Ordinances:
A. 27-1202.1 to permit a three-unit multifamily residential use that is otherwise not allowed in the RC-2 Zoning District.
B. Section 27-2002.3 to permit a total of 3 off street parking spaces where 6 spaces would otherwise be required.
The applicant testified to the size of the units as well as the addition of 2 more parking spaces in the rear, giving him a total of 5 off street spaces. The Zoning Hearing Board granted the relief for both variances as requested.
