BOROUGH CODES WILL BE INSPECTING SIDEWALKS TODAY!

Please make sure that you have your sidewalks clear as we have had multiple calls from delivery services that are saying that it is impossible to deliver some individuals items due to their walks.

Below is the ordinance of the borough for Snow and Ice Removal.

ARTICLE V
SNOW AND ICE REMOVAL
Adopted 3-2-1995 by Ord No 1995-1 amended in its entirety 9-1-2005 by Ord No 2005-4

169-39 Sidewalks to be cleared.

It shall be unlawful hereafter for the owner and/or occupant of any property on any street in the Borough, where there is a sidewalk abutting said property, to permit an accumulation of snow or sleet to remain upon said sidewalk for a period in excess of 24 hours after said snow or sleet ceases to fall thereon.

169-40 Obstruction of snowplowing operations prohibited.

No person shall interfere with the snowplowing of any portion of any of the Borough streets by obstructing the travel or operation of snowplowing vehicles operated on behalf of the Borough by placing any object, vehicle or one's self in a manner that prevents movement of the vehicle past any point on any Borough street or prevents the movement of depositing of snow or sleet in any location.

169-41 Deposit on streets prohibited.

No person, including, but not limited to, any resident or contractor performing private snowplowing operations or clearing snow or sleet by shovel, plow or snow blower within the the Borough, shall cause snow or sleet to be deposited from any premises within the Borough onto any Borough street.

169-42 Placement of snow or sleet

Snow or sleet shall not be plowed and piled from a driveway against the opposite curb. Snow or sleet shall be plowed back onto the property from which it was plowed or shoveled and feathered along the curb line of the same property so that piles do not extend into the street.

169-43 Parking restrictions

NO CAR may be parked on any Borough street whenever snow or sleet has accumulated on the street to such a depth that snow or sleet removal operations will be required.

169-44 Violations and penalties

Property owners are responsible for the actions of their contractors and may be held responsible for any violation of this article committed by their contractor. Each violation of a section of this article shall constitute a separate and distinct violation independent of any other section or any order issued pursuant to this article. Each day's failure to comply with any section shall constitute a separate violation. Any person violating the provisions of this article shall be subject to a fine not exceeding $1,000 or imprisonment for a period not exceeding 30 days or a period of community service not exceeding 30 days.

169-45 Additional remedies

If the owner and/or occupant of said property permits, causes or allows said snow or sleet to remain upon or to be put upon said sidewalk in violation of this article, the Borough may cause such snow or sleet to be removed and shall charge the owner and/or occupant with the actual cost of such removal, together with a penalty of $50, which cost and penalty shall be collected from the occupant and/or owner in the manner provided by law for the collection of municipal claims or by action of assumpsit, provided that the recovery of said costs and penalty may be in addition to the penalty imposed as provided in 169-44 of this article.
